Recently, in accordance with the "Announcement on the Acceptance of Administrative Ruling on Major Patent Infringement Disputes" published by "China Intellectual Property News", Huawei has officially filed an administrative ruling on Xiaomi's patent infringement disputes, and the case has been accepted by CNIPA.
It is showed in the announcement that on January 17, 2023, CNIPA accepted the case filed by the petitioner Huawei that the respondent Xiaomi infringed four of its Chinese patents, the contents of which are related to "method and device for sending control signaling" and " Method base station and user device for feeding back ACK/NACK information during the aggregation of carrier wave ", "A method and terminal for obtaining panoramic images" , and "A method for locking screen and mobile terminal". In terms of patent content, it mainly involves technologies such as lock screen, signal control and photography. From the perspective of patent content, cases No. 1 and No. 2 involve 4G/LTE technology, which are belong to standard essential patents (SEPs). Cases No. 3 and No. 4 involve mobile phone camera and unlocking technologies, which are non-SEP patents.
"Both parties have been actively negotiating on patent licensing." On March 1, the relevant person in charge of Xiaomi Group responded that China's intellectual property protection system provides a variety of resolution mechanisms, including administrative and judicial mediation. It is an industry practice to solve based on a third-party mediation mechanism.
“Xiaomi and Huawei believe that intellectual property licensing and cooperation are benefit to promoting innovation and the public interest, and recond that mediation is an effective channel to help achieve licensing. In the meantime of continuing to actively negotiate, the parties seek to use a variety of mediation mechanisms to assist the two parties reach an agreement," Xiaomi said.
