Insta360 wins preliminary ruling in US ITC 337 investigation and sues GoPro for patent infringement

Insta360 (688775) announced that it has received the preliminary ruling from the U.S. International Trade Commission (ITC) regarding the Section 337 investigation. Based on the announcement, among the six U.S. patent allegations filed by GoPro in this investigation, ITC determined that some of Insta360's products infringed upon one design patent. However, the company's proposed new design proposal has been recognized by ITC and is deemed non-infringing. The remaining 5 allegations related to invention patents were either ruled invalid or not infringed.

 

Insta360 stated that it has filed Inter Partes Review (IPR) proceedings with the U.S. Patent and Trademark Office (USPTO) to challenge the validity of GoPro’s involved patents, with some patents currently under examination. At the same time, Insta360 has initiated a patent infringement lawsuit against GoPro in China. The 337 investigation this time is an administrative proceeding without involving compensation claims and has no substantial influence on the company’s current production and operations.

 

The announcement noted that the above progress is only a preliminary ruling, further ITC procedures are still required, and the final ruling remains uncertain. Insta360 will continue to monitor the progress of the case and defend its rights in various legal ways.
