On June 9, 2026, the German Federal Patent Court held an invalidity hearing for EP2947606 ("Mobile terminal") and declared the patent invalid. All auxiliary requests filed by the patentee, Nera Innovations, were rejected. A written judgment is expected to be issued in the coming months.

Since the protection period for EP2947606 has already expired, Nera can no longer seek injunctive relief based on this patent. Nera may appeal to the German Federal Court of Justice after receiving the written grounds for the judgment. However, though the appeal succeeds, its claims would be limited to damages for past infringement.

So far, all three of Nera’s patent – infringement lawsuits against Xiaomi have been lost at the first instance.

Status of the other two cases

Nera Innovations is a private equity-backed Non-Practicing Entity (NPE) that does not manufacture any products itself. The three patents it asserted against Xiaomi were all acquired from LG Electronics and Giesecke & Devrient. Before this hearing, the other two patents had already failed.

EP2642632 (“Wireless power receiver and method of manufacturing the same”)：UPC’s Hamburg Local Division (LD) announced the ruling (ACT_19746/2024) on July 10, 2025, the patent was held invalid in its granted form.

To strive for the patent, Nera submitted two amended, narrower claim sets (i.e., auxiliary requests), the first was also found invalid; the second was accepted by the court, but the accused Xiaomi products did not fall within the scope of the narrowed claims, so the infringement claim did not hold.

EP2916418 (“Wireless charging and communication board and wireless charging and communication device”)： before the Landgericht München I (Munich I Regional Court), the parallel infringement proceedings for this patent (21 O 4817/24) was stayed after a negative non-binding preliminary opinion (NBPO) by the Bundespatentgericht (Federal Patent Court of Germany).

On February 11, 2026, the German Federal Patent Court declared the patent invalid, core claims (1, 2, and 7) of the patent were deemed invalid as granted, and Nera’s auxiliary requests led nowhere.
