【GE CHENG News】Breaking news! Huawei sues MediaTek at UPC for infringement of its 5G patents

Huawei and MediaTek have further expanded the global patent dispute between each other.

 

On April 8, 2025, Patent Watch for Enterprises (PRIP) learned from the European Unified Patent Court (UPC) that Huawei has sued MediaTek and MediaTek Germany for infringing multiple patents.

 

There are currently two cases and patents that have been made public (there may be more undisclosed).

 

The first is Case No. ACT_13761/2025 filed on March 24, 2025, at the UPC Munich LD, involving European patent EP3905840, titled "SIGNAL INDICATION FOR FLEXIBLE NEW RADIO (NR) LONG TERM EVOLUTION (LTE) COEXISTENCE". This is a patent applied for in 2018 and related to 5G technology.

 

The second is Case No. ACT_14180/2025 filed on March 25, 2025at the UPC Munich LD, involving European patent EP4142215, titled "METHOD AND APPARATUS FOR OBTAINING UE SECURITY CAPABILITIES". This patent was also applied for in 2018 and related to 5G technology.


Huawei's second time of suing MediaTek shows that there are still great differences between the two parties on licensing negotiations.

 

Last month, the British court’s judgment fully disclosed the patent litigation between the two parties in several places around the world when it did not record that the two parties had any litigation in the European Unified Patent Court (UPC).

 

The UK court ruling disclosed: Huawei sued MediaTek in five courts, and MediaTek sued Huawei in three courts.

 

Huawei's lawsuit against MediaTek includes: First, on May 14, 2024, it filed infringement claims for two patents involved 4G and one patent involved 5G with the Shenzhen Court and sought an injunction. For the jurisdiction dispute of this lawsuit, the Supreme People's Court of China has already rejected MediaTek's appeal. Second, on August 16, 2024, in the second round of lawsuits, Huawei filed an infringement lawsuit with the Shanghai Intellectual Property Court on the grounds of three 5G patents, filed an infringement lawsuit in the Beijing Intellectual Property Court on August 19, 2024, and filed an infringement lawsuit in the Guangzhou Intellectual Property Court on two 5G SEPs on August 20, 2024, and filed an infringement lawsuit in Hangzhou on two 5G SEPs on August 21, 2024.

 

MediaTek's lawsuit against Huawei includes: First, on July 12, 2024, MediaTek filed three infringement claims against Huawei involving 4G and 5G patents in Shenzhen, Zhengzhou and Hangzhou, and sought an injunction. Second, on July 12, 2024, MediaTek filed an antitrust lawsuit with the Beijing court.

 

In addition, MediaTek also filed an infringement claim at the Munich District Court in Germany on July 12, 2024.

 

Except for that above, last week PRIP revealed that MediaTek is also launching a patent invalidation challenge against Huawei's NPE, which may mean that in addition to the above-mentioned public dispute between the two parties, NPE entities related to Huawei is also involved in MediaTek's law enforcement actions.
