Nio rejects claim its being accused of exploiting battery-swapping patents in $250 million suit

The Financial Times reported that the owners of a defunct Israeli start-up filed a lawsuit against a $25 billion Chinese EV maker for intellectual property infringement, This Israeli company once pioneered in the development of EV infrastructure.


Charge Peak, a company registered in the British Virgin Islands and controlled by Canadian businessman Larry Krauss issued a cease-and-desist letter to NIO on three European patents involving battery replacement technology. These patents were acquired by EV Group Better Place after its bankruptcy in 2013. Better Place, an Israeli company established in 2027, once attempted to revolutionize the automotive industry and reduce reliance on fossil fuels by developing the network of battery charging and swapping stations.


The lawyer of Charge Peak accuses Nio in the letter of “exploiting, without permission or license, the Israeli Better Place model, technology, experience, and IP,” Charge Peak did not specify a particular amount of compensation, but offered Nio the opportunity to buy the entire IP portfolio (including more than 20 patents) of Better Place to solve disputes, asking for 2% of Nio’s 2025 annual revenue of $12.5 billion as the baseline of compensation, which would amount to $250 million.


Nio denied the patent infringement allegations, saying that it had filed over 2,200 patents related to battery charging and swapping, which are “materially different from the three patents referenced in the claim.”

While patent and intellectual property disputes are commonplace in China's EV industry, including conflicts between domestic competitors, this latest accusation becomes a new variable to Nio's turbulent development. However, Nio's operations have become more stable facing fierce domestic competition and weak overseas demand over the past 18 months, with sales increasing by 50% year-on-year to over 326,000 vehicles last year.


Charge Peak has issued a deadline of June 5 for Nio to respond.
