According to the news from CNIPA, it will make convenient arrangements for priority examination of invention patents in the Mainland by Hong Kong SAR applicants in the form of pilot projects.

In terms of the pilot project, starting from January 1, 2023, permanent residents of the Hong Kong SAR, companies established in accordance with the Companies Ordinance of the Hong Kong SAR, and other legal entities or organizations in the Hong Kong SAR may apply for registration through the Guangzhou and the Shenzhen representative office of CNIPA Patent Office to submit relevant application materials, so that invention patent applications that meet the relevant conditions can obtain priority examination in the Mainland.

It is understood that the invention patent application applicable to the pilot project must be an invention patent application in the mainland of Hong Kong SAR applicants in the substantive examination stage, and its technical field belongs to the "Administrative Measures for Patent Priority Examination" (Decree No. 76 of CNIPA) The relevant application classification numbers fall within the scope of the " "Relationship Table of Strategic Emerging Industry Classification and International Patent Classification (2021) (Trial)".

Hong Kong SAR applicants could submit the application materials for priority examination of patents to the service window of the Guangzhou Agency of CNIPA Patent Office or the Shenzhen Agency of CNIPA Patent Office by submitting in person or by mail, but cannot submit the same application materials to the two agencies repeatedly.
