Integration of State Intellectual Property Office: no longer retain the Patent Reexamination Board/the Trademark Review and Adjudication Board/the Cooperation?Center for Trademark Examination

According to the reform deployment of the central government, the original Patent Reexamination Board of the State Intellectual Property Office is incorporated into the Patent Office of the National Intellectual Property Administration, the original State Administration for Industry and Commerce Trademark Office, the Trademark Review and Adjudication Board, and the Cooperation?Center for Trademark Examination are integrated into Trademark Office of the National Intellectual Property Administration. The Patent Reexamination Board, the Trademark Review and Adjudication Board, and the Cooperation Center for Trademark Examination are no longer retained. Zhao gang, the director of the original Trademark Review and Adjudication Board is appointed as the deputy director general of the National Intellectual Property Administration.

According to the No. 295 Announcement of the National Intellectual Property Administration, relevant matters are announced as follows:

I. After the institutional adjustment, the examination of patent and trademark works will be carried out in the name of the National Intellectual Property Administration. The organization names of the original Patent Reexamination Board, the original State Administration for Industry and Commerce Trademark Office, the Trademark Review and Adjudication Board, and the Cooperation?Center for Trademark Examination are no longer used.
The business procedures relevant to the original Patent Reexamination Board, the original State Administration for Industry and Commerce Trademark Office, the Trademark Review and Adjudication Board, and the Cooperation Center for Trademark Examination remain unchanged. The pending matters will be carried out by the new institutions which continue to exercise their authorities, the notifications/forms issued, the administrative decisions made, and various agreements signed continue to be valid.

II. After the institutional adjustment, the business seals of the original Patent Reexamination Board, the original State Administration for Industry and Commerce Trademark Office, the Trademark Review and Adjudication Board, and the Cooperation?Center for Trademark Examination are deactivated, and new business seals are uniformly enabled. The new business seals consist of “the National Intellectual Property Administration” plus specific business types.

III. After the institutional adjustment, the “National Intellectual Property Administration” is uniformly used to replace the original Patent Office of Intellectual property, the Trademark Office of Intellectual property, the original Patent Reexamination Board, the Trademark Review and Adjudication Board, and the original Cooperation?Center for Trademark Examination in request sheets/forms and issued notifications/forms relevant to the examination of patent and trademark works.

IV. The new business seals and request sheets/forms will be start using on April 1, 2019, while the old business seals and request sheets/forms will be deactivated.

V. After the institutional adjustment, the office address of the new institution responsible for patent reexamination and invalidation remains unchanged. The address: The Patent Reexamination and Invalidation Office of the National Intellectual Property Administration, 10-12 floors, Yingu Building, No.9, Bei Si Huan West Road, Haidian District, Beijing.

The office address of the new institution responsible for trademark registration and examination remains unchanged. The address: Trademark Office of National Intellectual Property Administration, No.1 Chama South Street, Xicheng District, Beijing.
